These Terms and Conditions ("Agreement") govern the use of the services ("Service") made available by Digiqore Info Solutions Private Limited ("www.digiqore.in", "we" or "us"). This Agreement represents the whole agreement between Digiqore Info Solutions Private Limited and the individual or entity that subscribes to our service ("Subscriber" or "you").
PLEASE READ THIS AGREEMENT CAREFULLY. By submitting your application and by your use of the Service, you agree to comply with all of the terms set out here. We may terminate your account at any time, with or without notice, for conduct that breaches this Agreement or that we believe is harmful to our business or to any other party. We may change or modify this Agreement at any time, effective upon posting to this URL. You are responsible to read this document from time to time to ensure compliance.
We offer subscribers domain name registration, website hosting and email hosting services for the duration of the service term purchased. Services are provided on the basis of facility and equipment availability, and we reserve the right to modify, change or discontinue any aspect of the Services at any time. Access to the web and email servers is terminated upon expiry of the Service.
All web hosting accounts display a "Coming Soon" web page by default when activated, which the subscriber may remove once they have access to the web server. All web page error requests (such as 403 or 404 errors) direct traffic to a default error page. At its sole discretion, Digiqore may place advertisements or other commercial content on your website, emails or anywhere it deems fit. Promotional offers and special introductory rates are only available to new customers and are only valid for the initial term; all hosting services renew at the regular renewal rate.
Our email service provides customers the capability to send and receive email via the Internet. We retain the right, at our sole discretion, to restrict the volume of messages transmitted or received to maintain quality of service and protect our computer systems. As owner and operator of the equipment, we have the legal right to block electronic communications from other entities on the Internet.
What "Unlimited" means: we do not set an arbitrary limit on the number of resources an account can use; unlimited resources are intended to meet the typical needs of an average small/home business website. What it does not mean: accounts are not intended for large enterprises, online storage/backup warehouses, media streaming hubs, or any unreasonable practice. Reselling any of the Service's resources is strictly prohibited (unless on a Reseller/VPS/Dedicated plan). Accounts adversely affecting the performance of others by excessive resource use may be asked to move to VPS or Dedicated Server services; serious offenses result in suspension or termination.
All fees are quoted and billed in INR unless otherwise noted. We use an automated payment processing system and accept NEFT, RTGS, IMPS, Cheque, Cash and Google Pay. Service fees are due at the time of order or on the day of renewal and must be paid in full. Invoices are shared via email and WhatsApp. Billing disputes must be raised within 30 days of the invoice date. Accounts are suspended if renewal fees are not paid within 72 hours of the due date and re-activated once cleared.
Only one refund may be issued for each invoice. We reserve the right to grant or deny any refund requests.
We do not allow unsolicited commercial email ("Spam") or bulk SMS to promote products or services. The following is a non-exclusive list of prohibited content and behavior: nudity/pornography/adult content; warez, cracks, hacks and piracy-related information; content promoted through Spam; grossly offensive content (bigotry, racism, hatred, profanity); content exploiting children under 18; unlawful products/services; content infringing intellectual property; content promoting mail fraud or pyramid schemes; disclosure of third-party personal information without consent; and reverse engineering of any Digiqore service or technology.
Digiqore reserves the right and sole discretion to: censor any inappropriate website hosted on its servers; review accounts for excessive space/bandwidth and suspend those exceeding allowed levels; terminate any account for non-payment or fraudulent information; terminate any account whose website is subject to legal action; terminate any account for Spam, hacking, distribution of viruses or similar harmful activities; and suspend the Service when necessary for technical reasons or maintenance.
The Service is provided on an "as is" and "as available" basis and use is at your own risk. Digiqore makes no representations or warranties, express or implied, with respect to the Service. We are not responsible for any damages, injury or economic loss arising from the use of the content or Service, including any direct, indirect, incidental or consequential damages.
You agree to indemnify and hold Digiqore, its affiliates, partners, directors, officers and employees harmless from any and all losses, damages, liabilities, claims, judgments, settlements, fines, costs and expenses arising out of or relating to your breach of this Agreement or your (or any third party's) use of the Services.
Digiqore will not be liable for any delay, interruption or failure caused by acts of God, COVID-19, war, fire, flood, storm, earthquake, power failure, inability to obtain equipment/supplies, labor disputes, or other similar events beyond our control.
The rights and obligations of the parties are governed by the laws of India. Any disputes, claims or legal proceedings shall be exclusively subject to the jurisdiction of the courts located in Jalpaiguri, West Bengal, India.
We do not accept agreements and payments from persons under the legal age of 18 years. This Agreement represents the complete agreement between us with respect to the Service and supersedes any other written or oral agreement. If any part of this Agreement is found invalid or unenforceable, that part will be ineffective only to that extent, without affecting the remaining parts.
